Town of Pinckney Fee Schedule

  • ARTICLE 1. INTRODUCTION

    The following RULES, REGULATIONS and FEE STRUCTURE associated with the Town of Pinckney Zoning Law and Subdivision Control Law, are hereby adopted by resolution by the Town Board of the Town of Pinckney on July 14, 1987 and amended by resolution#54-2014 on May 13 2014.

  • ARTICLE 2. FEES ASSOCIATED WITH SUBDIVISION CONTROL LAW

    2.05  Application Fees:  Application fees are to cover filing costs, public hearing costs, administrative costs, and overhead costs and are to be paid to the town clerk prior to the planning board accepting the application as complete.  If application is denied, application fee and any consultant or SEQR charges shall not be returned.  Fees are as follows: 
    Minor Subdivision (2, 3 or 4  lots) | Sketch plan: none | Preliminary Plat: $100 | Final Plat: $100

    Major Subdivision (5 or more lots) | Sketch plan: none | Preliminary Plat: $150 + $25/lot | Final Plat: $150
    2.10  Consultant Fees:  See Article 7. 
     
    2.15  SEQR Fees:  See Article 6. 
     
    2.20  Inspection:  Inspections of public improvements shall be charged to the applicant on the basis of hourly rate of time spent on inspections.  Such hourly total shall be based upon the hourly rate charged to the town by the engineer on retainer.
  • ARTICLE 3. FEES ASSOCIATED WITH ZONING LAW – SITE PLAN REVIEW

    3.05  Application Fee for Principal Uses and Structures:  Application fee of $40 shall be paid to the town clerk prior to the planning board accepting an application for site plan review as complete.  This fee shall cover filing costs, public hearing costs, administrative costs and overhead costs.  If application is denied, application fee and any consultant or SEQR charges shall not be returned. 
     
    3.10  Application Fee for Accessory Uses and Structures and Alterations to Principal or Accessory Uses and Structures:  An application fee of $25 shall be paid to the town clerk prior to the planning board accepting an application for an accessory site plan review as complete.  This fee is to cover filing costs, public hearing costs, administrative costs and overhead costs.  If application is denied, application fee and any consultant or SEQR charges shall not be returned. 
     
    3.15  Application With Both Principal and Accessory Uses/Structures:  Where an application for a site plan review includes both principal and accessory uses and/or structures, only a principal use or structure fee shall be charged. 
     
    3.20  Consultant Fees:   See Article 7. 
     
    3.25  SEQR Fees:  See Article 6.

  • ARTICLE 4. FEES ASSOCIATED WITH ZONING LAW – ZONING PERMITS

    4.05  Zoning Permits for Principal Uses and Structures:  An application fee of $40 shall be paid to the town clerk prior to the zoning officer issuing a zoning permit.  This fee shall cover costs of filing and inspection. 
     
    4.10  Zoning Permits for Accessory Uses and Structures and Alterations to Principal or Accessory Uses and Structures:  An application fee of $25 shall be paid to the town clerk prior to the zoning officer issuing a zoning permit.  This fee  shall cover costs of filing and inspections. 
     
    4.15  Temporary Zoning Permits:  An application fee of $25 shall be paid to the town clerk prior to the zoning officer issuing a temporary zoning permit.  This fee shall cover costs of filing and inspections. 
     
    4.20  Zoning Permit Renewals:  Where construction has not substantially begun or the use has not commenced within one year from the date a zoning permit has been issued, the zoning permit may be renewed after a fee of $20 is paid to the town clerk. 
     
    4.25  Site Plan Review Referral:  Where an application for a zoning permit is referred to the planning board for site plan review, the fees of this section shall not apply, and only the fees of Article 3 above shall apply. 
     
    4.30  Application With Both Principal and Accessory Uses/Structures:  Where an application for a zoning permit includes both principal and accessory uses and/or structures, only a principal use or structure fee shall be charged. 
  • ARTICLE 5. FEES ASSOCIATED WITH ZONING LAW – ADMINISTRATION

    5.05  Appeals:  An application fee of $75 shall be paid to the town clerk prior to the cooperative zoning board of appeals accepting an application for an interpretation or a use or area variance as complete.  This fee shall cover filing costs and public hearing costs.  Additional consultant fees (see Article 7) and SEQR fees (see Article 6) may also be charged, at the discretion of the cooperative zoning board of appeals. 
     
    5.10  Zone Changes:   An application fee of $75 shall be paid to the town clerk prior to the town board accepting a zone change application as complete.  This fee shall cover filing costs, public hearing costs, administrative costs, and overhead costs.  Additional consultant fees (see Article 7) and SEQR fees (see Article 6) may also be charged, at the discretion of the town board. 
     
    5.15  Fees for Documents:  The town clerk shall charge $5 for the public distribution of each copy of the Town of Pinckney Zoning Law and Subdivision Control Law.
  • ARTICLE 6. FEES ASSOCIATED WITH SEQR

    6.05  SEQR Fees:  Pursuant to Section 6l7.17 of Part 617 “State Environmental Quality Review” (SEQR) of the NYCRR and Subdivision 8-0109.7 of the ECL, the lead agency shall charge a fee to the applicant to cover the actual costs of preparing or reviewing an Environmental Impact Statement (EIS).  If applicant prepares the EIS, the lead agency shall charge applicant for the actual cost of the review.  If applicant does not choose to prepare EIS, lead agency shall charge applicant for the actual cost of preparing EIS.
  • ARTICLE 7. FEES ASSOCIATED WITH CONSULTANTS

    7.05  Consultant Fees:  The town board, planning board and the cooperative zoning board of appeals may retain consulting services from engineers, architects, landscape architects, lawyers, planners or other professional services during the course of zone changes, site plan reviews, variances or interpretations conducted pursuant to the Town of Pinckney Zoning Law, and subdivision plat reviews conducted pursuant to the Town of Pinckney Subdivision Control Law.  The applicant shall pay any actual costs attributable to the consultant’s review of an application.
